2. Scope of Service & Clinical Decision-Support Nature

Boostara Innovations provides artificial intelligence technology for clinical decision support, medical imaging analysis assistance, intelligent software, and digital creation.

IMPORTANT CLINICAL NOTICE: Boostara X-Ray AI and related medical AI tools are designed as assistive clinical technologies intended to support qualified healthcare professionals. Boostara is NOT an autonomous medical doctor and does not establish a doctor-patient relationship. Qualified clinicians retain full responsibility for verifying findings, formulating diagnoses, and determining patient management pathways.

3. User Accounts & In-App Encrypted Vault

When you create an account on Boostara applications, you agree to provide accurate registration information. You are responsible for safeguarding your device access credentials, PINs, and biometric authenticators. Because Boostara utilizes client-side In-App Encrypted Vault architecture (AES-256-GCM), decryption keys are anchored to your physical hardware; Boostara Innovations cannot recover locally encrypted records if your device credentials are lost.

4. Scan Tokens, Usage-Based Billing & M-Pesa Payments

Boostara X-Ray AI operates primarily on transparent, usage-based scan token packages:

• Scan Token Deduction: One (1) scan credit is deducted upon successful completion of a clinical image analysis and structured report generation.
• Payment Methods: Payments are processed securely via Safaricom M-Pesa, authorized credit cards, or institutional purchase orders.
• Volume Discounts: Bulk clinic and hospital packages are discounted based on volume tiers.
• No Hidden Subscriptions: Purchased tokens do not expire under active accounts and have no recurring mandatory monthly lock-in unless explicitly chosen under enterprise PACS SLA agreements.

5. Acceptable Use & Ethical Compliance

You agree not to use Boostara systems for unlawful activities, unauthorized penetration testing, reverse engineering model weights, or uploading fraudulent data. You represent that you have obtained all necessary patient authorizations and institutional permissions required under applicable healthcare data protection regulations (including the Kenya Data Protection Act 2019, HIPAA, and GDPR).

6. Intellectual Property

All proprietary foundation model architectures, weights, source code, user interfaces, branding, and documentation are the exclusive intellectual property of Boostara Innovations. Users retain ownership of their original patient records and clinical notes stored in their Sovereign In-App Vault.

7. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in Kenya.
